RENTAL AGREEMENT

Schedule A: Terms and Conditions

This Term and Conditions (the “Agreement”) is made by and between MPJ Vacation Rentals Ltd. (“The Management”) acting on behalf of the Property Owner (“Homeowner”) and you (personally or being the legal entity on whose behalf the individual is acting) (“Guest”).  For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

Property. The property is furnished and includes appliances, furniture, linens, towels, washer and dryer, and a reserved parking space etc.

Vacation of property: The guest undertakes to vacate the holiday home at the end of the period of the lease no later than 10:00 check out time and to deliver the apartment to the management at that time, the apartment being vacant of persons and the tenant’s possessions and in the same condition as the apartment was received.

 

In the case of the guest not vacating the apartment on their departure date by 10:00 the guest shall be immediately liable for the entirety of the security deposit.

In such a case the management has the right to enter the flat, change the lock, not allow the guest or his representatives to enter the apartment and may remove the guest’s belongings and place them in storage. 

 

Any storage expenses will be charged to the guest. The management will take no responsibility for the guest’s stored belongings.

Cancellation Policy: If Guest wishes to cancel his/her reservation, the deposit minus 100 USD cancellation fee and any processing fees will be refunded as follows:

  • 50% if cancelled 30 days prior to the Check-in Date

  • 0% if cancelled within 30 days of the Check-in Date

Notice: The total payment once made is non-refundable.

If the Management company or the homeowner cancel the reservation for any reason, they will be obligated to refund any and all money that has been paid to them for the reservation.

General. (i) This Agreement constitutes the full and entire understanding and agreement between the Parties and replaces any previous agreements and/or communications between the Parties;

 

(ii) this Agreement shall not be amended, modified or varied by any oral agreement or representation or otherwise then by written instrument executed by both Parties or their duly authorised representatives;

 

(iii) no failure, delay or forbearance of either Party in exercising any power or right hereunder shall in any way restrict or diminish such Party’s rights and powers under this Agreement or operate as a waiver of any breach or non-performance by either Party of any of the terms or conditions hereof;

 

(iv) this Agreement may not be assigned by Guest without the prior written consent of the Homeowner;

 

(v) This Agreement may be executed in any number of counterparts and by different parties hereto in separate counterparts, each of which when so executed and delivered shall be deemed to be an original and all of which taken together shall constitute but one and the same document;

(vi) This Agreement shall be construed in accordance with the laws of the State of Israel without regard to its conflicts of laws provisions. Any and all controversies, claims or disputes arising out of or related to this Agreement or the interpretation, performance or breach thereof, shall be and brought exclusively before the appropriate courts in the Jerusalem district in the State of Israel.

Maximum Stay: Stay for more than twenty-one days is not allowed unless agreed upon in writing.

Access: Guests shall allow The Management access to the property for purposes of repair and inspection.  The Management shall exercise this right of access in a reasonable manner.

7.1.

Special Provision: In the event that "EL AL Israel Airlines Ltd" cancels flights to Israel, preventing the guest's arrival within 24 hours of the scheduled check-in date, the guest will be eligible for a full refund. Should "EL AL" delay the guest's arrival but still permit arrival within the reservation period, the guest may choose to receive a refund for missed nights or request an extension of the reservation, subject to availability.

This provision refers specifically to EL AL and/or other Israeli national airlines, as they are the only carriers that consistently operate air transport to and from Israel. International airlines may choose to suspend or resume flights based on commercial or political considerations, while national carriers maintain essential connectivity regardless of circumstances.

Payment: Unless agreed otherwise between the parties, an acceptable payment method is a bank transfer by the Guest to the property owner.

Rental Rules: Guest agrees to abide by the Rental Conditions (referred to in this Agreement as Exhibit A) at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.

Security deposit: The deposit is for security and shall be refunded within 7 days of the Checkout Date minus processing fees (limited to bank transfer fees in the event the guest cancels, if the owner cancels the fees will be not be deducted) incurred provided no deductions are made due to:
 

  1. damage to the property or furnishings;

  2. dirt or other mess requiring excessive cleaning; This does not include normal anticipated dirt from an extended stay (e.g., 18 nights). Spilled foods or other staining substances on furniture and bed linens is not anticipated and may entail an additional cleaning fee,

  3. any other cost incurred due to the Guest's stay. This does not include normal expenses that a landlord would incur and be responsible for when renting a fully furnished unit. This includes and is not limited to electricity, water and gas, wifi, normal cleaning and maintenance fees from regular wear and tear.

Liability:  In no event Homeowner or MPJ Vacation Rentals Ltd. shall be liable for any loss of use, business interruption, loss of data, cost of substitute goods or services, or for any punitive, indirect, special, incidental or consequential damages of any kind in connection with or arising out of this agreement or the performance or failure to perform this agreement, whether alleged as a breach of contract or tortious conduct, including negligence, even if a party has been advised of the possibility of such damages.

 

Except bodily injury, death, damage to real or tangible personal property occurred by action or omission, in no event shall Homeowner’s aggregate cumulative liability under this agreement will be limited to the aggregate fees paid by the Guest. Each party agrees that the foregoing limitations, exclusions and disclaimers are a reasonable allocation of the risk between the parties and will apply to the maximum extent permitted by applicable law, even if any remedy fails in its essential purpose.

Insurance: We encourage all renters to contract a travel insurance.
